Please read these Terms of Use (“Terms”) carefully before using Keep Photos (“the App”) developed and maintained by the Keep Photos team (“we,” “us,” or “our”).

By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, subject to these Terms and the Apple Media Services Terms and Conditions.

3. Description of Service

Keep Photos is a photo and video vault application that stores your content locally on your device, protected by a PIN you create. The App operates entirely on your device with no server component, no user accounts, and no cloud storage.

4. Your Responsibilities

PIN Security

You are solely responsible for creating and remembering your PIN. If you forget your PIN, your vault contents cannot be recovered. We do not have access to your credentials and cannot reset your PIN or unlock your vault under any circumstances. There is no “forgot PIN” recovery option.

Content

You are solely responsible for the content you store in the App. You agree not to use the App to store content that violates applicable laws in your jurisdiction.

Device Security

The security of your vault depends on the security of your device. We recommend keeping your device software up to date and using a device passcode.

Backups

The App stores data locally only. We do not maintain backups of your data. You are responsible for maintaining any backups you consider necessary, including using the App’s Export feature.

5. Pro Subscription

Subscription Plans

The App offers optional Pro features through auto-renewable subscriptions:

• Pro Yearly — billed annually
• Pro Monthly — billed monthly (may include a free trial period)

Prices are displayed in the App at the time of purchase and may vary by region and currency.

Payment and Renewal

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of the selected plan.
• If your renewal payment fails, Apple may provide a billing grace period during which you retain access to Pro features while Apple retries the charge.

Free Trial

• If a free trial is offered, the trial duration and eligibility are determined by Apple.
• Free trial eligibility may be limited to one trial per Apple ID.
• Any unused portion of a free trial is forfeited when you purchase a subscription.

Managing and Canceling

You can manage or cancel your subscription at any time through your device’s Settings > Apple ID > Subscriptions, or through the App Store. Cancellation takes effect at the end of the current billing period. You retain access to Pro features until that period expires.

Refunds

Refund requests are handled by Apple per their refund policy. We do not process payments or issue refunds directly. To request a refund, visit reportaproblem.apple.com.

Pro Features

Pro features include but are not limited to: break-in capture, intruder log, decoy vault, face-down auto-lock, and alternate app icons. The specific features included in Pro may change over time. Free features remain available without a subscription.

Downgrade

If your Pro subscription expires and is not renewed, Pro features become inaccessible. Your data created with Pro features (such as decoy vault contents and intruder logs) is preserved on your device but cannot be accessed until you resubscribe.

6. Data Loss and Recovery

Given the local-only nature of the App:

• We are not responsible for data loss resulting from forgotten PINs, device loss, device damage, iOS updates, or App deletion.
• We cannot recover vault contents under any circumstances.
• Deleting the App removes all vault data permanently.
• You are solely responsible for exporting and backing up any data you wish to preserve.

7. Intellectual Property

The App and its original content, features, design, and functionality are owned by Keep Photos and are protected by copyright and other intellectual property laws. Your vault contents remain your property. These Terms do not grant you any rights to our trademarks, logos, or branding.

8. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Use the App for any unlawful purpose
• Attempt to circumvent the App’s security features
• Distribute, sublicense, or make the App available to third parties

9. No Warranty

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, secure, or error-free
• Lost or forgotten PINs can be recovered
• Data can be recovered after deletion or device loss

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR PROFITS, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid for the App or its subscriptions in the twelve (12) months preceding the claim.

11. Third-Party Terms

Your use of the App is also subject to Apple’s Media Services Terms and Conditions. In the event of a conflict between these Terms and Apple’s terms regarding the use of the App, Apple’s terms shall govern to the extent of the conflict.

12. Apple as Third-Party Beneficiary

You acknowledge that these Terms are between you and us only, not with Apple. However, Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

13. Indemnification

You agree to indemnify and hold harmless Keep Photos and its developer from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

14. Termination

We may terminate or suspend your license to use the App at any time, without prior notice, for conduct that we believe violates these Terms. Upon termination, your license to use the App ceases. Sections 6, 9, 10, 12, and 13 survive termination.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policyand Apple’s Media Services Terms and Conditions, constitute the entire agreement between you and us regarding the App.

17. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by the “Last updated” date at the top. Material changes will be communicated through an in-app notice. Your continued use of the App after changes constitutes acceptance of the revised Terms.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
